AnsaldoBreda: the Mott MacDonald report confirms the reliability of the V250 Fyra train. Unclear the rejection of the Court of Arnhem to make the MMD report available to AnsaldoBreda. Seriously damaged the image and the reputation of the company.
As known to those who have followed the complex matter of the V250 Fyra trains under supplying from
AnsaldoBreda to the Belgian and Dutch railways, the decision to “terminate” the related contracts was
made by the Belgian customer (later duplicated by the Dutch client) on the basis of a mysterious report
commissioned by him to a specialized company, report from which it turns out that the Fyra trains are
hopelessly unsafe and unreliable and that it would not be reasonable to entrust the repair to AnsaldoBreda.
Mott MacDonald, British independent body among the most respected in the international sphere and
author of the aforementioned report, is known for its seriousness, independence and reliability; hence the
AnsaldoBreda astonishment for these alleged findings and the resulting request to the court in Arnhem to
be able to have access to the document, access that on the 8th of October the Court rejected.
In the meantime, however, a few days before the unfavorable decision of the Court of Arnhem, the report
has been fully published by several newspapers and sites in the Netherlands, and here the mystery was
discovered: the report does not say what the Belgian railways sustained; on the contrary it confirms what
the company always supported, and that is that the V250 Fyra train is safe and reliable.
In fact the report states that “the conclusion of Mott MacDonald is that the trains are substantially
compliant with the contractual agreement between the Customer and AnsaldoBreda”, that “there are
some differences that either have been accepted by the customer to start the service or that are
irrelevant”, that “AnsaldoBreda has fully cooperated with Mott MacDonald and has supplied all the
answers and the required documents promptly and thoroughly”, that “in the opinion of Mott MacDonald it
is technically possible to identify, with AnsaldoBreda, a plan for the removal of the found failures” and that
it is reasonable to assume that such a program can be completed within 17 months.
From all this it not only appears unequivocally that, as mentioned, the V250 Fyra train is safe and reliable,
but also that AnsaldoBreda has collaborated in a transparent and proactive way with Mott MacDonald and
that the Belgian railways have released a version of the report contents strongly altered, unleashing a
smear campaign that, together with the following decision also taken by the Dutch Railways to terminate
the contract, is a source of enormous damagesto the reputation and the prestige of AnsaldoBreda, known
both nationally and internationally as a leader company in the production of rolling stock within transport.
In this situation it is even more unclear the decision taken by the Dutch court of Arnhem to deny the
delivery of the Mott MacDonald report to AnsaldoBreda, not only because the document was, at the time
of the decision, in the public domain for days, but because it de facto exonerates AnsaldoBreda from the
attributed responsibilities.
AnsaldoBreda considers extremely serious and significant the damage resulting from the behavior of its
customers and has therefore decided that it will start in every occasion all the necessary actions to get, in
addition to the compliance with the contractual commitments, also the refund of all the damages caused
by the illegitimate behavior of the counterparties.
